Teddington house allegedly converted into four flats without permission

A family dwellinghouse in Teddington has allegedly been converted into four self-contained flats without planning permission.
However, the owner of the building located at 192 Kingston Road claims that the building has only been converted into two flats, referred to as 192A and 192B, as stated in the original planning application.
In a planning application document, K1 Studio, on behalf of the site's owner, said: "The PCN alleges a material change of use of the property from a single family dwellinghouse (maisonette) to four self-contained residential units without planning permission.
"This statement addresses that allegation directly and sets out the extensive evidence demonstrating that the use of the building as self-contained residential flats has been in place for well over the applicable statutory time period, such that the use is lawful by operation of law and immune from enforcement action."
It continued: "The LPA's enforcement officer first made contact with the owner by email on 19 January 2026, referencing 192C Kingston Road and stating that the Council had strong evidence of a conversion to four self-contained flats.
"NKM Studio responded on 22 January 2026 on behalf of the owner, confirming engagement with the Council and indicating that an LDC application would be submitted. This statement and the accompanying LDC application fulfil that commitment.
"The owner and his agents have engaged openly and constructively with the Council throughout. The owner does not accept that any breach of planning control is currently actionable."
K1 Studio said that the " conversion of this building into self-contained flats demonstrably occurred before 25 April 2024, by a margin of approximately ten years", suggesting that the conversion aligns with the Levelling-up and Regeneration Act 2023.
According to K1 Studio, the building in question is a converted residential property containing self-contained flats addressed as 192A and 192B, each with its own independent gas installation, electrical installation, boiler, hob, utility meter, and Energy Performance Certificate.
The PCN alleges conversion to four units.
However, K1 Studio said: "The owner acknowledges that there is further one unit (192 C) within the building and reserves the right to provide supplementary evidence in respect of those units under separate cover or as part of an expanded LDC application.
"This flat is currently vacant at the council order."
A Metro Prepaid UK electricity meter transaction report in April 2026 records four separately metered units at the property, all registered to owner Necip Onemli.
These are identified as Unit 1 (which is consistent with a communal or landlord supply), 192a, 192b and 192c.
The existence of four separately metered supplies within the building, all registered to the same owner, is strongly corroborative of the building having been physically divided into multiple selfcontained units for a substantial period.
The PCN alleges conversion to four self-contained units and says the electricity meter data is consistent with that physical arrangement.
The PCN was served on 11 March 2026, nearly eight years after the original planning application was submitted.
The planning application document said: "The evidence submitted with this application establishes, clearly and on the balance of probabilities, that 192 Kingston Road, Teddington, has been in continuous use as self-contained residential flats since at least June and July 2014, with evidence of prior inspections suggesting an even earlier conversion date.
"The conversion pre-dates 25 April 2024. By virtue of the transitional provisions of SI 2024/452, the original four-year rule applies.
"The four-year period expired by no later than September 2018. The use is lawful by operation of law.
"The London Borough of Richmond upon Thames is bound in law to grant a Lawful Development Certificate under Section 191 of the Town and Country Planning Act 1990 confirming the lawfulness of the existing use of the building at 192 Kingston Road, Teddington as self-contained residential flats.
"The owner and his agents remain willing to engage constructively with the Council and to provide any further information or clarification that may assist the determination of the LDC application or the resolution of the enforcement inquiry."
Richmond Council expects to respond to the PCN's allegations by 12 August.
